b) YOU ACKNOWLEDGE THAT YOU WILL NOT UNDER ANY CIRCUM-STANCES(i) USE CHEATS, EXPLOITS, AUTOMATION SOFTWARE, BOTS,HACKS, MODS OR ANY UNAUTHORIZED THIRD PARTY SOFTWARE DE-SIGNED TO MODIFY OR INTERFERE WITH THE SERVICES;(Ii). BECOME INVOLVED IN ANY TYPE OF ATTACK, INCLUDING WTHoUT LMI-TATION DISTRIBUTON OF A VIRUS, DENIAL OF SERVICES ATTACKS UPONTHE SERVICES, OR OTHER ATTEMPTS TO DISRUPT THE SERVICES; OR

d) YOU ACKNOWLEDGE THAT YOU WILL NOT UNDER ANY CIRCUM-STANCES (i) WTHOUT OUR EXPRESS WRIITEN CONSENT, USE THE SER-VICES OR ANY PART THEREOF FOR ANY COMMERCIAL PURPOSE, IN-CLUDING BUT NOT LIMITED TO (1) COMMUNICATING OR FACILTATNGANY COMMERCIAL ADVERTISEMENT OA SOLCITATION, OR (2) GATHER-NG OR TRANSFERRING VIRTUAL ITEMS FOR SALE;(Ii) USE THE SERVICESOR ANY PART THEREOF ROR PERFORMING SERVICES, SUCH AS

FancyLove: Choice&Stories owns, solely and exclusively, all right, title and interest in and tothe Services and all content contained and/or made available on, through orin connection therewith (the "Content”), and all such Content is protected,without limitation, under U.S. Federal and State, as well as applicable laws.rules, regulations and treaties. The term “Content”includes, without limitation, all services, titles, artwork, photographs, illustrations, animations, graph-ics, logos, text, themes, objects, characters, character names, stories, sto-rylines, dialogue, musical compositions, audio-visual effects, methods of operation, documentation, in-game chat transcripts, character profle informa-tion, concepts, computer code, data, user interfaces, visual interfaces, infor-mation, materials, and all copyrightable or otherwise legally protectable ele-ments of the Services, including, without limitation, the design, selection, se-quence, look and feel, and arrangement of the Services and its dedicatedwebsite, and any copyrights, trademarks, database rights and/or other intel-lectual property and/or proprietary rights therein (including with respect toany content contained and/or made available in any advertisements or infor-mation presented to you via the Services). We have the right, but not the obligation, to review any User Postingand to delete, remove, move, edit or reject, without notice to you, for anyreason ar for no reason whetsoever, any User Postings, including, withoutimitation, any Unauthorized Postings; provided, however, that We shall haveno obligation or lisbillty to you or any third party for failure to do so or fordoing so in any particuler manner. After you submit,post, email,display, transmit or otherwise make available any User Posting, you continue to retain any such rights thet you may have in such User Posting, subject to
the rights, licenses and privileges granted herein. You also represent, warrant and covenant that:(1) you own the User Posting posted by you or otherwise have the right to grant the rights, licenses and privileges described in these
Terms and to perform and comply with all of the requirements set forth herein;(i) yaur submission, posting, emeiing, displaying, transmission and/ar making available of User Postings does not violate these Terms, any rights of any other party or entity, any of your obligations, any law, rule or regulation
or infringe upon, misappropriate or violate any intellectuel property. propri-etary, privacy, moral, publicity or other rights of any party ar entity;(i) you are not a minor and you have the legal right and capability to enter into these
Terms of Use and perform and comply with all of its terms and condlitions or,if you are a minor over the age of thirteen (13), your parent or legal guardian has agreed to these Terms of Use on your behalf; and (iv) you hold and shall

SOME JURISDICTIONS DO NOTALLOW FOR THE EXCLUSION OF CERTAIN WARRANTIES OR CERTAINLMITATIONS ON DAMAGES AND REMEDIES, ACCORDINGLY SOME OF THEEXCLUSIONS AND LIMITATIONS DESCRIBED IN THESE TERMS OF USE

These Term, together with any additional terms, rules, our Privacy Policy.and any other regulations, pracedures and policies which we refer to andwhich are hereby incorporated by reference, contain the entire understandingand agreement between you and FancyLove: Choice&Stories concerning the Services and su-persedes any and all prior or inconsistent understandings relating to the Ser-viaes and your use thereof. These Terms of Use cannot be changed or termi-nated orally. If any provision of these Terms is held to be illegal, inwalid orunenforceable, this shall not afiect any other provisions and these Termsshall be deemed amended to the extent necessary to make it legal, valid andenfarceable. Any provision which must survive in order to allow us to enforceits meaning shall survive the termination of these Terms; however, no actionarising out of these Terms or your use of the Services, regardless of form orthe basis of the claim, may be brought by you more than one year after thecause of action has arisen.
B. This Agreement does not create any reletionship of principal and agent,partners, employer and employee, fiduciary or similar relationship betweenthe parties. You are prohibited from making any promise, warranty or repre-sentation on behalf of FancyLove: Choice&Stories or obligeting FancyLove: Choice&Stories in any way. You maynot represent to any person that yau are the agent of FancyLove: Choice&Stories, or ere au-thorized to act on its behalt.
C. The waiver or failure by FancyLove: Choice&Stories to exercise any right provided for hereirwill not be deemed a waiver of any further right hereunder. The rights andremedies of FancyLove: Choice&Stories set forth in this Agreement are cumulative and are inaddition to any rights or remedies FancyLove: Choice&Stories mey otherwise have at law orequity, except with respect to any sale and exclusive remedies expressly pro-vided for herein.
D. You acknowledge and agree that any breach or threstened breach of thisAgreement may cause immediate and ireparable harm to FancyLove: Choice&Stories whichwould not be adequately compensated by monetary damages and that FancyLove: Choice&Stories may seek injunctive reliet, specific performance, and/or other equitablerelief as a remedy for any such breach or anticipated breach without the ne-cessity of posting a bond or other security.
E. Neither You nar FancyLove: Choice&Stories shall not be responsible for delays or failures inperformance resulting from acts of strikes, lockouts, riots, ects of war andterrorism, embargoes, boycotts, changes in govemmental reguletions, epi-demics, communication line failures, power failures, earthquakes, ftre, otherdisasters or any other reason where failure to perform is beyond the control
of, and not caused by, the nan-performing party.
F. These Terms and your use of the Services is governed by, construed andenforced in accordance with the internal substantive laws of the Stete ofWashington applicable to contracts made, executed and wholly performed inWashington, and, for the purposes of any and all legal or equitable actions,you specifically agree and submit to the exclusive jurisdiction and venue ofthe State and Federal Courts situated in the State of Washington and agreeyou shall not object to such jurisdiction or venue on the grounds of lsck ofpersonal jurisdiction, forum non corvenienge or otherwise. IN ANY ACTIONOR PROCEEDING COMMENCED TO ENFORCE ANY RIGHT OR OBLIGATIONOF THE PARTIES UNDER THIS AGREEMENT, YOUR USE OF THE SERVICESOR WTH RESPECT TO THE SUBJECT MATTER HEREOF, YOU HEREBYWAIVE ANY RIGHT YOU MAY NOW HAVE OR HEREAFTER POSSESS TO ATRIAL BY JURY.
